Terrifying Daleks will try to exterminate Dr Who when the telly sci-fi classic returns to our screens just as we predicted.

Fans had feared the worst after a legal wrangle threaten to rule the famous foes out - but yesterday producers confirmed the deal had been reached.

BBC drama boss Mal Young said: "It's good news."

The Daily Star told in March the BBC bosses were willing to break the bank to ensure the doctor's mortal enemies featured in the remake.

The row with the robots' owners, the estate of their creator Terry Nation, has overshadowed filming for the £1m-an-episode hit.

But yesterday, Tim Hancock, a spokesman for the estate, said: "We have reached an agreement on terms for the use of the Daleks.

"We look forward to working closely with the production team in the forthcoming months."

The series, written by Russell T Davis, will see actor Christopher Ecclestone, 40, play the Time Lord, with Billie Piper, 21 as his sidekick Rose Tyler.
