[edit]

A TEACHER who illegally sold Dr Who goods on eBay was reprimanded at a disciplinary hearing yesterday.

Hayley Batley, a teacher of 10 years at St Giles Primary School, Wrexham, broke down in tears when she admitted unprofessional misconduct before an Education Workforce Council Fitness to Practice panel in Ewloe.

In June 2013 BBC chiefs warned Ms Batley she was not allowed to sell Dr Who items on her eBay "Silly Bear Clothing" account which were trademark protected.

They were initially taken down by the internet auction site, but she was caught re-listing goods later that year.

An investigation discovered she had listings for more than 1,600 trademarked goods including Dr Who, James Bond, The Beatles and The Rolling Stones.

Ms Batley insisted she would never have done it if she had known she was doing anything wrong and apologised.

But imposing a reprimand, panel chairman Steve Powell said: "Her conduct was serious and unacceptable and must not happen again." He added she should be "mindful of the impact of her actions."

It will lie on her record for two years and can be disclosed to any future employers.

Ms Batley was given a 12-month conditional discharge at Caernarfon Crown Court in November 2014 after admitting charges of infringing trademarks.

St Giles has also put her on a final written warning, which also lies on her record for two years, after a disciplinary hearing because it was felt her actions were prejudicial to the school's name.

Choking back the tears at the hearing Ms Batley, during evidence, said: "I admit stupidity, naivety and ignorance of the law.

"I didn't think I was doing anything wrong and I did not expect that I would end up in court. I would never do anything like this again."

At yesterday's hearing, she accepted one count of selling trademark protected goods in July 2013, seven counts of offering trademark protected goods for sale in September 2013 and one count of unacceptable professional conduct.

Asked how she would explain what she had done to children by presenting officer Rhiannon Dale, she said: "I would tell the children that I did something wrong and I didn't mean to do it and I would tell them I'm sorry and sometimes you make mistakes."

A school representative said she was "a dedicated and loyal member of staff."
